That's true about the domain not being his, but the domain itself (and the server, and the bandwidth) were all bought and paid for by donations to the DarkyROM project, made when Darky was still very much active. As Swiper says, it's a tough one to call.
One thing is quite clear, communication is everything on a project of any kind.

I can understand the feelings from both sides, it's just a shame because they had a good product.
The latest according to twitter is that they are to split into two separate "organisations" - Darky and Swiss Android going one way while Ficeto, Robbie and Goldie go the other. It could prove good for us end users (more roms to choose from) or bad (it fizzles out altogether and there is one or two less developers prepared to support our devices). This info is subject to change of course.
Eventually, it'll be the community that decides which becomes more popular. Ficeto is the Kernel man though, and unless Darky finds a top notch coder, and quickly, he's going to have one hell of an uphill struggle on his hands. Ficeto controls the user database (and thus userbase).
Why can't we all just get along? Life's too short.
